Agreeing to these terms

By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the service.

Who can use Playmakers Win

You must be at least 21, or the minimum age for sports betting where you live if that’s higher, and able to enter a binding contract. You’re responsible for knowing and following the laws that apply to you, including whether sports betting is legal where you are. The service isn’t offered anywhere it would be illegal.

What Playmakers Win is, and isn’t

Playmakers Win provides sports information and analysis for information and entertainment: scores, statistics, odds published by third-party sportsbooks, AI-assisted game analysis and graded picks.

• We’re not a sportsbook. We don’t accept, place or settle bets, and we never handle money for betting.
• Picks are opinions, not promises. Nothing in the service is financial, investment, legal or other professional advice, or a guarantee of any result. Past results, including the record we show for each grade, don’t guarantee future ones.
• Data and analysis can be wrong. AI-generated content can be inaccurate or incomplete, and odds, scores and other data can be delayed or wrong.
• Your bets are your decisions. Any bet you make, and any gain or loss from it, is yours alone.

Your account

Give us accurate information and keep it up to date. Keep your password safe: you’re responsible for what happens on your account. An account is for one person, so don’t share, sell or transfer it. If you think someone else is using your account, tell us right away at support@playmakerswin.com.

Premium subscriptions

• Premium is an auto-renewing subscription sold through the Apple App Store or Google Play. The price and billing period are shown before you buy, and payment is charged to your store account.
• A subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your store account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting your Playmakers Win account doesn’t cancel it. How to cancel.
• If we offer a free trial, any unused part of it ends when you buy a subscription.
• Refunds are handled by Apple or Google under their policies, except where the law requires otherwise.
• We may change what Premium includes or what it costs. Price changes follow the store’s rules and take effect no earlier than your next renewal.

Using the service fairly

Don’t:

• copy, sell, share, publish or redistribute our picks, analyses or other Premium content, including in paid groups or channels;
• scrape the service, access it by automated means, or reverse engineer the app, except where the law allows it;
• try to get around security, usage limits or subscription checks;
• use the service to break the law, or to harass, deceive or harm anyone;
• upload anything unlawful or offensive, or anything you don’t have the right to share, for example as a profile picture or in a support message;
• interfere with or overload the service.

Our content and yours

The service, including our analyses, picks, grades, software, design, name and crest, belongs to us or our licensors. We give you a personal, non-transferable, revocable license to use it for your own non-commercial use under these terms.

You keep ownership of what you give us, such as your profile picture and support messages, and you allow us to use it only to run and improve the service.

Team, league and sportsbook names and logos belong to their owners. We use them only to identify teams, games and odds, and we’re not affiliated with or endorsed by any league, team or sportsbook.

Third-party data and services

The service relies on data from third parties, such as scores, schedules and sportsbook odds, and may link to other websites and services. We don’t control them and aren’t responsible for their content, accuracy or availability. The App Store and Google Play have their own terms, which apply to your purchases there.

Disclaimers

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the service will be uninterrupted or error-free, or that any pick will win.

Limits on liability

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for betting losses, lost profits or lost data, arising from your use of the service. Our total liability for any claim about the service is limited to the greater of what you paid for Premium in the 12 months before the claim and US$50.

If your breach of these terms or misuse of the service leads to a claim against us, you agree to cover our reasonable losses and costs from it, to the extent the law allows. Some places don’t allow these limits, so some of them may not apply to you.

Ending your use

You can stop using the service and delete your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the service. Terms that by their nature should last, such as ownership, disclaimers and limits on liability, continue after your access ends.

App Store terms

If you downloaded the app from Apple’s App Store, these terms also apply:

• These terms are between you and us, not Apple. Apple isn’t responsible for the app or its content.
• Your license to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store’s Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet an applicable warranty, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims.
• If anyone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating and handling that claim.
• You confirm that you’re not in a country subject to a U.S. government embargo or designated by the U.S. government as supporting terrorism, and that you’re not on any U.S. government list of prohibited or restricted parties.
• You must also follow any third-party terms that apply when you use the app, such as your carrier’s.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute about these terms or the service will be heard only in the state or federal courts located in New York, and you and we agree to their jurisdiction. This doesn’t take away any rights you have under the consumer protection laws of the place where you live.

Changes and contact

We may update these terms. We’ll change the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using the service after that, you accept the updated terms.
